Terms of Service

1. Introduction

WorkTito ("the Service") is provided by AbbitSmart ApS, a company registered in Denmark (CVR: [insert CVR number]). These Terms of Service form a binding agreement between you and AbbitSmart ApS. If you use the Service on behalf of a company, you confirm you are authorised to accept these Terms on its behalf.

2. The Service

WorkTito is an online workforce management tool for tracking employee working hours, calculating wages and overtime, scheduling shifts, managing time-off, and related features. The Service is provided on a subscription basis and may also be accessed through our mobile app.

3. Accounts

You must provide accurate information and keep your login credentials confidential. You are responsible for activity under your account. There are different roles — administrator, employer ("Owner") and employee — with different permissions. You must notify us of any unauthorised use.

4. Employer responsibilities

If you use WorkTito to manage employees, you are responsible for: (a) having a lawful basis to collect and process your employees' data, including work location captured at clock-in/out; (b) informing your employees about such processing; and (c) the accuracy of the wage rates, hours and payments you record. AbbitSmart ApS acts as a data processor for this employee data, as described in our Privacy Policy.

5. Free trial

We may offer a free trial period. At the end of the trial, continued use of paid features requires an active paid subscription. We may modify or withdraw trial offers at any time.

6. Subscriptions & fees

Paid plans are billed according to the plan you select. Payments are processed through PayPal. Fees are stated exclusive of any applicable taxes unless otherwise indicated. Unless required by law, fees already paid are non-refundable. If a subscription is not renewed or a payment fails, access to paid features may be suspended. You can stop using the Service or delete your account at any time.

7. Acceptable use

You agree not to: use the Service unlawfully; misrepresent working hours or wage data to deceive; attempt to gain unauthorised access to other accounts or our systems; upload malicious code or unlawful content; or interfere with the Service's operation.

8. Your content

You retain ownership of the data and files you submit ("Your Content"). You grant AbbitSmart ApS a limited licence to host and process Your Content solely to provide the Service. You are responsible for ensuring you have the rights to any content you upload.

9. Intellectual property

The Service, including its software, design and trademarks (including "WorkTito"), is owned by AbbitSmart ApS and protected by law. These Terms do not grant you any rights in it except the limited right to use the Service as intended.

10. Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may perform maintenance, and may modify or discontinue features with reasonable notice where practicable.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service unlawfully. On termination, your right to use the Service ends; data handling on termination is described in the Privacy Policy.

12. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties. WorkTito assists with time and wage tracking but is a tool: you remain responsible for verifying hours, wages and legal/payroll compliance.

13. Limitation of liability

To the maximum extent permitted by applicable law, AbbitSmart ApS shall not be liable for indirect, incidental or consequential damages, or for loss of profits or data. Nothing in these Terms limits liability that cannot be limited under Danish law. Where liability is permitted to be limited, our total liability is limited to the amounts you paid for the Service in the 12 months before the claim.

14. Governing law

These Terms are governed by the laws of Denmark, and disputes are subject to the jurisdiction of the Danish courts, without prejudice to any mandatory consumer protection rights you may have.

15. Changes to these Terms

We may update these Terms. Material changes will be indicated by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
